These Terms and Conditions (“Terms”, “Terms and Conditions”) govern your relationship with www.sebocanada.ca website (the “Website”) operated by SEBO Canada, a division of Floor Care Equipment Ltd. (“us”, “we”, “our”, or “SEBO Canada”).

Your access to and use of the Website is based on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Website.

By accessing or using the Website you agree to be bound by these Terms and accept all legal consequences. If you do not agree to these terms and conditions, in whole or in part, please do not use the Website.

Intellectual Property Rights

Other than the content you own, under these Terms, SEBO Canada and/or its licensors own all the intellectual property rights and materials contained in the Website.

The Website and all contents, including but not limited to text, images, graphics or code are the property of SEBO Canada and are protected by copyright, trademarks, database and other intellectual property rights. You may display and copy, download or print portions of the material from the different areas of the Website only for your own non-commercial use, or to place an order with SEBO Canada. Any other use is strictly prohibited and may violate copyright, trademark and other laws. These Terms do not grant you a license to use any trademark of SEBO Canada or its affiliates. You further agree not to use, change or delete any proprietary notices from materials downloaded from the Website.

Indemnification

You agree to indemnify, defend and hold harmless SEBO Canada, its principals, officers, directors, representatives, employees, contractors, licensors, licensees, suppliers and agents, from and against any claims, losses, damages, losses, obligations, costs, actions or demands.

These include but are not limited to: (a) legal and accounting fees resulting from your use of the Website; (b) your breach of any of these Terms; (c) anything you post on or upload to the Website; and (d) any activity related to your account. This includes any negligent or illegal conduct by you, any person or entity accessing the Website using your account whether such access is obtained via fraudulent or illegal means.

Limitation Of Liability

SEBO Canada, its directors, employees, partners, agents, suppliers, or affiliates, shall not be liable for any loss or damage, direct or indirect, incidental, special, consequential or punitive damages, including without limitation, economic loss, loss or damage to electronic media or data, goodwill, or other intangible losses, resulting from (i) your access to or use of the Website; (ii) your inability to access or use the Website; (iii) any conduct or content of any third-party on or related to the Website; (iiv) any content obtained from or through the Website; and (v) the unauthorized access to, use of or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other claim in law, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Disclaimer And Non-Waiver of Rights

SEBO Canada makes no guarantees, representations or warranties of any kind as regards the website and associated technology. Any purportedly applicable warranties, terms and conditions are excluded, to the fullest extent permitted by law. Your use of the Website is at your sole risk. The Website is provided on an “AS IS” and “AS AVAILABLE” basis. The Website is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance, except as provided for under the laws of any province in Canada. In such cases, the provincial law shall apply to the extent necessary.

SEBO Canada and its subsidiaries, affiliates, and its licensors do not warrant that a) the Website will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Website is free of viruses or other harmful components; or d) the results of using the Website will meet your requirements.

If you breach any of these Terms and SEBO Canada chooses not to immediately act, or chooses not to act at all, SEBO Canada will still be entitled to all rights and remedies at any later date, or in any other situation, where you breach these Terms. SEBO Canada does not waive any of its rights. SEBO Canada shall not be responsible for any purported breach of these Terms caused by circumstances beyond its control. A person who is not a party to these Terms shall have no rights of enforcement.

You may not assign, sub-license or otherwise transfer any of your rights under these Terms.

Exclusions

As set out, above, some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you. Provincial laws of Canada may apply to certain products and service provided.

Assignment

SEBO Canada is allowed to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.

Governing Law

These Terms shall be governed by, and interpreted and enforced in accordance with, the laws in the Province of Alberta and the laws of Canada, as applicable.

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, then any remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Website, and supersede and replace any prior agreements, oral or otherwise, regarding the Website.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By using this Website you are expected to review these Terms on a regular basis.

By continuing to access or use our Website after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, please stop using the Website.

SEBO Canada Warranty Terms and Conditions

Standard 5-year warranty coverage:

The standard 5-year warranty applies to all SEBO vacuum cleaners (excluding the SOFTCASE CE12 – see below), ET power heads, DUO Brush machines, and DISCO Polishers. SEBO Canada or an Authorized SEBO Dealer located in Canada will provide the original owner free repair services, and any parts needed to fix a broken or defective SEBO machine (listed above) that falls within the scope of ordinary household use for the following warranty periods, all of which begin on the date of the new product purchase:

  • Five years motor(s) – SEBO motors (brush and suction) are covered.
  • Five years non-wear parts. See Item #4 for list of exclusions.
  • One year labor – all warranty labor must be performed by SEBO Canada or an Authorized SEBO Dealer located in Canada.
  • Lifetime AUTOMATIC X-Series Belts. On SEBO AUTOMATIC X vacuums, a lifetime warranty is provided on the drive belts, which also includes the labor costs to replace them.

SOFTCASE CE12 3-year warranty coverage:

The 3-year warranty coverage applies exclusively to the SOFTCASE CE12 upright vacuum. SEBO Canada or an Authorized SEBO Dealer located in Canada will provide the original owner free repair services, and any parts needed to fix a broken or defective SEBO SOFTCASE CE12 vacuum cleaner that falls within the scope of ordinary household use for the following warranty periods, all of which begin on the date of the new product purchase:

  • three years motor(s) – all SEBO motors (brush and suction) are covered.
  • three years non-wear parts. See Item #4 for list of exclusions.
  • three year labor – all warranty labor must be performed by SEBO Canada or an Authorized SEBO Dealer located in Canada.

Exclusive 10-year warranty coverage:

The exclusive 10-year warranty coverage applies to select vacuum cleaners purchased from SEBO dealers in Canada. An Assigned Registration Code is required to complete the extended warranty registration form and is found on the box of the vacuum cleaner. The online registration form needs to be completed within 30 days of purchase to qualify.

SEBO Canada or an Authorized SEBO Dealer located in Canada will provide the original owner free repair services, and any parts needed to fix a broken or defective SEBO vacuum cleaner (excluding the SOFTCASE CE12), DUO Brush Machine, or DISCO Polisher that falls within the scope of ordinary household use for the following warranty periods, all of which begin on the date of the new product purchase:

  • Ten years motor(s) – all SEBO motors (brush and suction) are covered.
  • Ten years non-wear parts. See Item #4 for list of exclusions.
  • Five years labor – all warranty labor must be performed by SEBO Canada or an Authorized SEBO Dealer located in Canada.
  • Lifetime AUTOMATIC X-Series Belts. On SEBO AUTOMATIC X vacuums, a lifetime warranty is provided on the drive belts, which also includes the labor costs to replace them.
Additional Terms and Conditions of Warranty:
  1. SEBO Canada or an Authorized SEBO Dealer located in Canada must complete all warranty repairs. Warranty coverage is not provided for a SEBO vacuum that was purchased in Canada but requires repairs outside of Canada.
  2. To locate an Authorized SEBO Dealer in your area please either use the Dealer Locator available here, or call SEBO Canada at 877-258-5005, or use our Contact Us form online.
  3. The warranties provided for above apply exclusively to SEBO vacuum cleaners, powerheads, DUO Brush Machines, and DISCO Polishers that are used residentially. A 1-year warranty is provided for SEBO machines that are used commercially.
  4. The Wear Parts excluded from warranty coverage include, but are not limited to, used filter (dust) bags, used micro-hygiene filters, used exhaust filters, the cable (external cord), the attachment hose, the brush rollers, the brush roller set or the edge brush, the front bottom plate, the rear bottom plate, the sealing strip, the attachment tube, the crevice nozzle, the upholstery nozzle, the dusting brush and all of the optional attachments.
  5. Bags and filters that have a manufacturer’s defect and are unused are covered under warranty and will be replaced with the same item.
  6. The sales receipt showing the date, price, and item purchased is the initial proof-of-purchase document, and it determines the validity of warranty. To be certain that your warranty claim can be processed as quickly and efficiently as possible, please retain your original receipt and complete the online registration form here (details of which were provided with your new SEBO vacuum cleaner).
  7. This warranty gives you specific legal rights. You may also have other legal rights, which vary from province to province.
  8. This warranty applies only to SEBO products purchased directly from SEBO Canada or an Authorized SEBO Dealer located within Canada.
The Warranty Does Not Cover
  • Dealer-sponsored vacuum maintenance and tune-up services.
  • Products that are second-hand or products outside of the warranty period.
  • Machines that have not been assembled, used, or maintained in accordance with the operating instructions.
  • Machines, bags, filters, and spare parts designed or intended for use in countries other than Canada.
  • Defects or damage caused by the use of non-genuine SEBO parts, including but not limited to bags, filters and spare parts, or machines that have unauthorized modifications.
  • Defects or damage caused by service or parts provided by a non-authorized SEBO dealer.
  • Machines in which filters have been washed and/or bags have been reused.
  • Typical wear and tear, accident, other casualty, misuse, neglect, improper use or maintenance, or any machine in which the serial number has been altered or removed.
  • Normal maintenance, such as the removal of clogs, cleaning brush rollers, or changing bags and filters.
  • Damage caused by external sources, such as liquids, plaster/drywall dust, construction debris, hot materials, weather, or proximity to heat, e.g., fires, ovens, radiators, etc.

Exclusive Remedy

The remedies provided under the terms of this Warranty are the purchaser’s exclusive remedies and are in lieu of any other remedies otherwise available.

Limitations and Exclusions

SEBO makes no other representations or warranties, expressed or implied and specifically excludes the implied warranties of merchantability and fitness for particular purpose.

SEBO will not be liable for incidental or consequential damages of any kind or nature. This disclaimer of implied warranties shall not apply to the extent said disclaimer is not allowed by applicable provincial law.

Terms & Conditions of Returns

SEBO Canada and our affiliated SEBO retailers use the following return policy on all items wishing to be returned for any reason other than manufacturing defect. Items which have a manufacturing defect should follow our warranty claim procedures by contacting your local dealer or emailing us at info@sebocanada.ca

  • Customers will be eligible to return items within 15 days of purchase for a full refund provided that:
    1. All returned items arrive at our warehouse, or authorized SEBO retailer, undamaged and in good condition.
    2. The vacuum or item must be in new condition, and unused, and in its original box/packaging.
  • All items being returned within 15 days after date of purchase require written authorization from SEBO Canada, or the authorized SEBO retailer prior to being returned. In order to attain this, submit a return request in your online account for the item and you will receive a return approval or denial in return.
  • There will be no refund or return on items past 15 days since the date of purchase.
  • All items damaged in shipping require immediate notification to SEBO Canada or the SEBO retailer with proof of pictures confirming damage to the item and packaging it arrived in.
  • For all items that have been used within 15 days of the purchase date, a minimum 20% restocking fee will apply. SEBO Canada and our retailers reserve the right to further alter the refund amount based on the condition of the item upon return.
  • If the item is new and unused but is returned damaged or in packaging different to its original box, a 15% re-boxing fee will apply.
  • Shipping costs for the return of all items are the responsibility of the customer. The customer may also return items in person to the warehouse or retailer who originally shipped the item to them.

Please note: Do not use adhesive packing slip envelopes, tuck tape, masking tape, duct tape, magic marker, or pen directly on the item or item packaging being returned. Clear packing tape is best.  Once the product is returned to the warehouse, and the return paperwork has been processed, you may be contacted by phone or email and a receipt of the refund will be emailed to you.
